ABSTRACT

Resumo A teoria do risco ou da responsabilidade objetiva dispensa a comprovação da culpa ou do dolo e tem como requisitos a ocorrência do dano e o nexo causal. Embora a constituição disponha a responsabilidade por acidente de trabalho como subjetiva, se tem observado na doutrina e no judiciário a adoção da responsabilidade objetiva em alguns casos de acidentes e doenças ocupacionais. Este estudo tem por objetivo analisar decisões do Tribunal Regional do Trabalho da 15ª Região - São Paulo para conhecer em que situações a corte tem utilizado a responsabilidade objetiva. A pesquisa quanti-qualitativa, de caráter exploratório e descritivo, foi desenvolvida com base em análise documental e revisão bibliográfica. A pesquisa documental foi realizada em acórdãos que continham o descritor "acidente de trabalho", disponíveis na base de dados do Tribunal Regional do Trabalho da 15ª Região, julgados no período entre 11/11/2015 e 10/11/2017. Os resultados indicaram que, do total de 559 casos julgados, em 275 a decisão foi de procedência, sendo 15% por responsabilidade objetiva. Considerando apenas os casos procedentes, a responsabilidade objetiva apareceu em 30,5% deles. Esse percentual revela que já é expressiva nessa corte a tomada de decisão com base na noção de responsabilidade objetiva, e que tal adoção tem potencial para afetar práticas de prevenção de acidentes.


Abstract The risk theory or objective liability dispenses proof of guilt or intent and requires only the occurrence of damage and the causal link. Although the constitution establishes the responsibility for work accidents as subjective, it has been observed in the doctrine and in the judiciary the adoption of objective liability in some cases of accidents and occupational diseases. This study aims to analyze the decisions of the Regional Labor Court of the 15th Region - São Paulo to know in which situations the court has used objective liability. The quantitative-qualitative, exploratory and descriptive research was developed based on document analysis and literature review. The document research was carried out in judgments that contained the descriptor "work accident," available in the database of the Regional Labor Court of the 15th Region, judged between 11/11/2015 and 10/11/2017. The results indicated that, of the total of 559 cases judged, in 275 the decision was founded, being 15% by objective liability. Considering only the founded cases, objective liability appeared in 30.5% of them. This percentage reveals that decision-making based on the notion of objective liability is already expressive in this court, and that such adoption has the potential to affect accident prevention practices.

ABSTRACT

Objetivo: analizar los biodatos que integran el expediente clínico odontológico desde el derecho mexicano y la bioética. Métodos: hermenéutica analógica aplicada a los documentos jurídicos y bioéticos que determinan los biodatos mínimos constitutivos de los expedientes clínicos estomatológicos en México. Resultados: jurídicamente se identificaron los biodatos y se categorización en función de su naturaleza (antecedentes heredo-familiares, antecedentes personales patológicos y no patológicos, padecimiento actual e interrogatorio por aparatos y sistemas) y de los datos personales sensibles (datos: personales, identificativos, laborales, patrimoniales, académicos, de tránsito y migración, de salud, biométricos, de características físicas, y, especialmente, protegidos). Conclusiones: el análisis de la aplicación de los principios bioéticos a los biodatos del expediente clínico odontológico identificó como medidas mínimas las siguientes: la existencia de consentimiento(s) informado(s); el buen tratamiento de los biodatos; el correcto tratamiento y manejo de seguridad de las bases de datos que contengan un expediente o un conjunto de ellos y la bioseguridad del material biológico y genético en biobancos.


Objective: To analyze the biodata that make up the dental clinical record from Mexican law and bioethics. Methods: Analogical hermeneutics applied to the legal and bioethical documents that determine the minimum biodata constituting the stomatological clinical records in Mexico. Results: Legally, biodata were identifed and categorized according to their nature (inherite-family history, pathological and non-pathological personal history, current condition and questioning by devices and systems) and according to sensitive personal data (data: personal, identifcation, labor, patrimonial, academic, transit and migration, health, biometric, physical characteristics, and especially protected). Conclusion: The analysis of the application of Bioethical principles to the biodata of the dental clinical record identifed as minimun measures: the existence of informed consent(s), the good treatment of the biodata, good treatment and security of the databases that contain a fle or a set them, the biosecurity of biological and genetic material in biobanks.

ABSTRACT

Resumen: avances biotecnológicos son abrumadores y la realidad social cambia con ellos. En efecto, la nueva ley en España sobre los matrimonios homosexuales ha propiciado que parejas de mujeres y de hombres que se casan puedan procrear no solo mediante la adopción, sino también por la fecundación in vitro. Así, la gestación por sustitución se está convirtiendo en la vía preferente para que parejas heterosexuales u homosexuales con problemas específicos, parejas de hombres y para el varón sin pareja puedan tener descendencia. Esta situación crea múltiples conflictos éticos y jurídicos difíciles de resolver: filiación del menor, mercantilización de la mujer, instrumentalización y compraventa de niños, etc. En este artículo se analizarán los aspectos bioéticos en conflicto, sin olvidar la regulación jurídica que existe al respecto.


Abstract: We find ourselves in a time of far reaching biotechnological breakthroughs and alongside with this, society is also experiencing changes. In this sense, new regulations regarding homosexual marriage have opened an scenario where same sex couples of men or women, may "procreate", not only by means of adoption - not permitted for homosexual couples in many countries - but also through in vitro fertilization. For this reason, surrogate pregnancy is becoming the option of choice enabling heterosexual couples with specific problems, male couples, and males without a female partner to have a child. Indeed, as surrogate pregnancy techniques proliferates, ethical conflicts arise: the possibility of men to have their own children, problems relating filiation, instrumentalization of women and babies, legal solutions given by different European countries. In this article, both bioethical and legal issues regarding surrogate pregnancy will be analyse looking for the best interest of the minors.


Resumo: Os avanços biotecnológicos são avassaladores e a realidade social se transforma com eles. Com efeito, a nova lei espanhola sobre o casamento homossexual tem propiciado que casais de mulheres e de homens que se casam possam procriar não só através da adoção, mas também por fertilização in vitro. Assim, a gestação por substituição está se tornando a alternativa preferida para que casais heterossexuais ou homossexuais com problemas específicos, casais de homens e homens solteiros possam ter filhos. Esta situação cria vários conflitos éticos e jurídicos que são difíceis de resolver: filiação da criança, mercantilização da mulher, instrumentalização e compra e venda de crianças, etc. Este artigo irá analisar os aspectos bioéticos, sem esquecer a regulação jurídica a este respeito.

ABSTRACT

This paper discusses medical records, which are often disputed during lawsuits and play an important role in the factfinding process. There have been no published reports of problems related to medical records or concrete measures to deal with these problems on the basis of a review of judicial precedents. To avoid lawsuits, medical records should be considered in the context of judicial precedents (previous court rulings). The present paper therefore analyzes basic matters related to medical records that were disputed during lawsuits, in relation to judgments obtained in previous court rulings, to determine the judicial role of medical records and their ownership. Although the ownership of medical records is unclear, we believe that patients have some ownership rights over their medical records, that hospitals are responsible for the control of the records, and that physicians have the obligation to use and prepare them. Therefore, medical records can be seen as being jointly owned by the medical care provider and the patient. Analysis of relevant judicial precedents has also allowed us to clarify essential points related to avoiding lawsuits.
